ABA to Consider UCITA OppositionThe House of Delegates of the American Bar Association will consider a recommendation by one of its sections to oppose the current version of the Uniform Computer Information Transactions Act and urge its revision “with due regard for basic rights of consumers.” The resolution will be debated August 6–7 at the ABA annual meeting in Chicago. The American Library Association’s Washington Office, in an announcement asking interested librarians to contact ABA delegates to explain the library position, explains that it is customary for the ABA to review and vote on any legislation proposed by the National Conference of Commissioners of Uniform State Laws. Until now, proponents of UCITA have prevented the review from taking place. The resolution from the ABA Tort and Insurance Practice Section also suggests that NCCUSL redraft the law to protect anyone signing licensing contracts from “unwarranted unilateral actions of the Licensor.” It’s expected that ABA will ask the commissioners to refrain from pursuing further state legislative action pending such a revision.
