Justice Department Appeals Blocking of Child Online Protection ActThe Justice Department filed an appeal April 2 to a ruling that blocked enforcement of the Child Online Protection Act, which requires commercial Web sites to obtain proof of age before delivering material considered harmful to minors. The New York Times’s Cybertimes Web site reported that a three-judge panel from the U.S. Court of Appeals for the Third Circuit is likely to hear the appeal later this year; if the Justice Department had not appealed, a full trial on the case would probably have been held before U.S. District Judge Lowell Reed, who issued the preliminary injunction blocking the law February 1. American Civil Liberties Union attorney Chris Hansen, one of the lead lawyers on the case, told the CNet online news service that if the appeals court makes a definitive ruling to either uphold or remove the injunction, the decision could be appealed to the U.S. Supreme Court or sent back to the district court.
